Legislation

Businesses have a legal responsibility to make sure their commercial waste is kept securely and disposed of correctly. The cost of commercial waste disposal is not included in business rates and each business must arrange to dispose of the waste it generates.

The Environmental Protection Act 1990 and Duty of Care regulations state that all businesses must ensure their waste is contained and either disposed of correctly by an authorised waste carrier, or is taken by the business to a licensed disposal site or tip (where a charge will be made).

Businesses cannot use the household waste recycling centres for free waste disposal. BEST is not licensed to carry or dispose of hazardous waste. You have extra responsibilities if you are storing hazardous waste. You can read about these on GOV.UK.
